Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, landing pages, forms, portals, applications, messaging programs, calling programs, and other online or offline services that link to or reference these Terms (collectively, the "Services") provided by Spokane Christian Schools ("School," "we," "us," or "our").

By accessing or using the Services, submitting a form, registering for an event, requesting information, or otherwise interacting with us through the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms are intended to provide a broad national baseline for school websites and communications. Additional disclosures, consents, or notices may apply depending on the particular program, campaign, school type, state law, or communication channel.

Eligibility and Authority

You represent that:

  • you are at least 18 years old, or you are using the Services under the supervision of a parent, guardian, or authorized school representative;
  • any information you submit is truthful, accurate, and complete;
  • if you provide information about a student, you have the authority to do so;
  • if you provide a phone number or email address, you are the subscriber, customary user, or otherwise authorized to consent to communications at that contact point.

Scope of Services

The Services may allow you to:

  • learn about the School and its mission, programs, admissions, events, and community offerings;
  • request information;
  • register for open houses, tours, interviews, or other events;
  • submit inquiries, applications, enrollment materials, and other forms;
  • receive emails, text messages, calls, voicemail messages, and related communications;
  • access certain third-party tools, portals, forms, calendars, payment systems, or educational platforms.

The Services are offered for informational, operational, admissions, enrollment, and community engagement purposes. Nothing on the Services constitutes a guarantee of admission, enrollment, financial aid, academic placement, employment, or any specific outcome.

Privacy and Communications Practices

Your use of the Services is also subject to our Privacy Policy, which is incorporated into these Terms by reference. In the event of a conflict between these Terms and the Privacy Policy as to privacy practices, the Privacy Policy will control with respect to those privacy issues.

By submitting information through the Services, you acknowledge that we may collect, use, and disclose personal information as described in our Privacy Policy.

Consent to Communications

By submitting a form, providing a phone number or email address, registering for an event, or otherwise requesting information from us, you agree that the School and its service providers may contact you regarding your inquiry and related school matters, subject to your consent choices, applicable law, and our Privacy Policy.

Depending on the context and the permissions you provide, these communications may include:

  • admissions follow-up;
  • event confirmations and reminders;
  • campus visit scheduling;
  • deadline notices;
  • application or enrollment updates;
  • tuition or account-related notices;
  • school community updates;
  • fundraising or promotional communications, where permitted and where you have provided any required consent;
  • safety, operational, or legally required notices.

These communications may be sent or placed by:

  • live agents or school personnel;
  • automated telephone dialing technology;
  • prerecorded or artificial voice technology;
  • AI-generated voice technology;
  • SMS or MMS text messaging;
  • ringless voicemail, direct-to-voicemail, or voicemail delivery technology;
  • email or other electronic messaging tools.

The FCC has confirmed that AI-generated voice calls are treated as "artificial" voice calls under the TCPA, and ringless voicemail to wireless numbers is subject to robocall rules. For telemarketing or promotional robocalls and robotexts, prior express written consent is required; informational communications may be governed by different consent standards depending on the content and channel.

Consent is not a condition of purchase, donation, or enrollment.

SMS, Calling, AI Voice, and Voicemail Program Terms

This section applies if you provide a mobile or other telephone number to us.

A. Program description

The School may use your number to send or place communications relating to:

  • admissions and inquiry follow-up;
  • event registrations and reminders;
  • tours and scheduling;
  • applications and enrollment;
  • service or account notices;
  • optional promotions, invitations, fundraising, or school marketing, where you have consented if required.

B. Use of automated technology

Where permitted by law and consistent with the consent you provide, the School and its vendors may use:

  • automated dialing technology;
  • prerecorded or artificial voice messages;
  • AI-generated voice messages;
  • ringless voicemail or direct-to-voicemail technology.

C. Consent standards

You agree that any consent you provide through a web form, checkbox, keyword, paper form, or other disclosed consent method may be used as evidence of your request and authorization to receive the communications you selected. Consent must be specific to the School and the communication purpose presented at the time of collection.

D. Message frequency

Message frequency varies. You may receive recurring communications depending on your relationship with the School, your pending inquiry or registration, and the preferences you select.

E. Charges

Message and data rates may apply. Your mobile carrier's standard messaging or calling charges may apply.

F. Opt-out

You may opt out of text messages at any time by replying STOP. You may also use other standard opt-out keywords if supported, including STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. For help, reply HELP where supported, or contact us directly using the contact information listed below.

You may revoke consent to receive calls or texts, including automated, prerecorded, AI-generated voice, or ringless voicemail communications, by any reasonable method that clearly communicates your request. We will honor revocation and do-not-contact requests as required by law and, where applicable, within no more than 10 business days.

G. Effect of opt-out

If you opt out, we may still contact you for communications permitted by law, including certain non-marketing operational, safety, or legally required notices.

H. No carrier liability

Wireless carriers are not liable for delayed or undelivered messages.

I. Number reassignment and accuracy

You agree to provide a valid number that you are authorized to use and to notify us promptly if your number changes. If your number is reassigned and another person receives messages intended for you, you agree to notify us so we can update our records.

J. Recording and logging

We and our service providers may log submissions, consent records, opt-ins, opt-outs, message events, call events, voicemail delivery attempts, and related metadata for compliance, fraud prevention, quality assurance, and dispute-resolution purposes.

Form Submissions and User Responsibilities

You agree not to:

  • submit false, misleading, or incomplete information;
  • impersonate another person;
  • submit another individual's phone number or email without proper authorization;
  • use the Services for unlawful, abusive, harassing, fraudulent, or disruptive purposes;
  • interfere with or attempt to gain unauthorized access to the Services or related systems;
  • upload malicious code or harmful content;
  • use the Services to send spam, exploit vulnerabilities, or evade opt-out controls.

We may reject submissions, suspend access, or block use of the Services if we believe these Terms have been violated or if needed to protect the School, users, or third parties.

Admissions, Enrollment, and School Information

Descriptions of programs, grades, events, tuition, calendars, or services are for general informational purposes and may change without notice.

Submission of an inquiry, RSVP, application, or other form does not guarantee:

  • admission;
  • enrollment;
  • financial aid;
  • scholarship availability;
  • grade placement;
  • program availability;
  • event attendance capacity;
  • continued offering of a listed service or activity.

The School reserves the right to modify admissions processes, policies, calendars, eligibility criteria, tuition, fees, and program offerings at any time, subject to applicable law and any separate signed agreements.

Intellectual Property

The Services, including their text, graphics, logos, images, videos, designs, layouts, compilations, and other content, are owned by or licensed to the School and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial use related to learning about or interacting with the School.

You may not:

  • copy, reproduce, republish, distribute, modify, display, or create derivative works from the Services except as expressly permitted by law or with our written permission;
  • use the School's name, marks, or branding in a misleading way;
  • scrape, harvest, or systematically extract data from the Services without authorization.

Third-Party Services and Links

The Services may include links to or integrations with third-party websites, calendars, payment processors, maps, forms, admissions tools, analytics providers, learning tools, communications platforms, or social media features.

We do not control and are not responsible for third-party services, their content, availability, or their privacy and security practices. Your use of third-party services is governed by their own terms and policies.

FERPA, COPPA, and School-Specific Legal Frameworks

Certain information maintained by the School may be governed by FERPA, COPPA, or other federal or state laws rather than general consumer website rules. These Terms do not limit rights or obligations under those laws.

Where educational records, child data, or school-authorized services are involved, the School may provide additional notices, consents, or agreements.

Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. The School disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

  • the Services will be uninterrupted, secure, or error-free;
  • forms, calendars, or integrations will always be available;
  • messages, calls, emails, or voicemail deliveries will be successfully transmitted or received;
  • carrier delivery will occur on any particular timeline;
  • the Services will be free from delays, inaccuracies, or harmful components.

This disclaimer matters in messaging programs because carriers, device settings, filtering, network issues, and third-party platforms can affect delivery even where the sender has done everything right.

Limitation of Liability

To the fullest extent permitted by law, the School and its affiliates, officers, trustees, employees, volunteers, agents, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or use, arising out of or relating to the Services or these Terms, even if advised of the possibility of such damages.

To the fullest extent permitted by law, the total liability of the School for claims arising out of or relating to the Services or these Terms will not exceed the greater of:

  • the amount you paid, if any, to use the specific Service giving rise to the claim; or
  • one hundred U.S. dollars ($100).

Some states do not allow certain limitations, so portions of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless the School and its affiliates, officers, trustees, employees, volunteers, agents, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your use of the Services;
  • your violation of these Terms;
  • your violation of applicable law;
  • your submission of another person's information without authority;
  • your misuse of the communications program or consent process.

Suspension and Termination

We may suspend, restrict, or terminate your access to the Services, or stop communications to or from you, at any time and without prior notice if:

  • we believe you violated these Terms;
  • we need to protect the Services, users, or the School;
  • required by law, regulation, carrier policy, or vendor requirements;
  • we discontinue a Service, campaign, or channel.

Termination does not affect rights or obligations that by their nature should survive, including consent records, payment obligations, dispute provisions, disclaimers, limitations of liability, and compliance logs.

Electronic Notices and Records

You agree that we may provide notices, disclosures, records, and other communications electronically, including by posting them on the Services, by email, by text message where appropriate, or by other electronic means permitted by law.

You agree that electronic records and signatures may have the same legal effect as paper records and handwritten signatures, to the extent permitted by law.

Geographic Scope

The Services are intended for use in the United States. We do not represent that the Services are appropriate or lawful for use outside the United States.

Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.

Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Spokane County, Washington, and you consent to personal jurisdiction and venue there, unless applicable law requires otherwise.

Dispute Resolution

The School encourages families and visitors to contact us directly to resolve any concerns before pursuing formal legal action. We are committed to addressing issues promptly and in good faith.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date and may provide additional notice where required by law. Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
